Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of THB Embroidery Studio(the “Service”), a browser-based embroidery digitizer and stitch simulator. By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

The Service lets you convert raster artwork into embroidery files, preview a live stitch simulation, and export machine files. DST export is production-ready. PES export is offered in beta and may produce files that require adjustment before stitching.

3. Accounts

• You must be at least 13 years old (or the minimum age in your country) to create an account.
• You are responsible for keeping your credentials confidential and for activity on your account.
• You agree to provide accurate information and to keep it up to date.

4. Trial and Subscription

We offer a 3-day free trial. After the trial, continued access requires an active paid subscription billed at the price displayed at checkout. You can cancel at any time from your billing page; your access continues until the end of the current paid period. See our Refund & Cancellation policy.

5. Your Content

You retain all rights to artwork and projects you upload (“Your Content”). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate the Service for you. You represent that you have the rights to upload Your Content and that it does not infringe anyone else’s rights.

6. Acceptable Use

• Do not upload content you do not have the right to use.
• Do not attempt to reverse engineer, scrape, or disrupt the Service.
• Do not use the Service to create unlawful, infringing, or harmful material.

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by THB Embroidery Studio and its licensors. Except for the limited rights granted in these Terms, no rights are transferred to you.

8. Disclaimers

The Service is provided “as is” without warranties of any kind. Embroidery output depends on your artwork, machine, hooping, stabilizer, and thread; we do not guarantee that any given file will stitch out perfectly on your equipment. Always run a test stitch before production.

9. Limitation of Liability

To the maximum extent permitted by law, THB Embroidery Studio is not liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months before the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms. On account deletion, Your Content is removed as described in our Privacy Policy.

11. Changes

We may update these Terms from time to time. If changes are material we will notify you (for example by email or in-app). Continued use after the effective date means you accept the updated Terms.
